1. Agreement to Terms

By accessing or using Backboard, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, please do not use our services.

2. Use of Our Service challenges

Eligibility: You must be at least 18 years old to use this service or have parental consent if under 18.

License: We grant you a limited, non-exclusive, non-transferable, and revocable license to use our platform for your personal or educational purposes.

Restrictions: You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without express written permission from us.

3. User Accounts

Account Responsibility: You are responsible for safeguarding your account information, including your password. You agree to notify us immediately of any unauthorized use of your account.

Accuracy of Information: You must provide accurate and complete registration information, and keep your account information updated.

4. Content

User Content: You retain all rights to the content you upload to our service. However, by uploading content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the content in connection with providing the Service.

Content Security: We will store your content securely on our servers, but we are not responsible for any content loss due to system failures or user error.

Prohibited Content: You agree not to post content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable.

5. Payment and Subscriptions

Subscription Plans: If you opt for a paid subscription, you agree to pay all fees according to the plan you choose. Prices are subject to change upon notice.

Billing: Billing will occur based on your chosen subscription cycle, and you authorize us to charge your payment method accordingly.

Cancellation: You can cancel your subscription at any time, but no refunds will be issued for partial months of service.

6. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Backboard and its licensors.

7. Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including breach of these Terms.

8. Limitation of Liability

In no event will Backboard, its affiliates, or their licensors, service providers, employees, agents, officers or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, the Service.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of Ontario, Canada, without regard to its conflict of law provisions.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
